ELEMENTS OF VIOLATION OF BOUNCING CHECKS LAW, BP twenty-two
One. The making, drawing, and issuance of any check to apply for account or for value. The accused must be the drawer, maker and issuer. In negotiable instruments law, mas tama yung drawer siya dahil yung maker is the one who created the promissory note. Pag drawer, bill of exchange; a check is always a bill of exchange. And issuer siya at the same time. Hindi pwede na either lang at dapat siya mismo ang pumirma.
Two. The knowledge of the maker, drawer, or issuer that at the time of issue he does not have sufficient funds in or credit with the drawee bank for the payment of the check in full upon its presentment.
Three. The subsequent dishonor of the check by the drawee bank for insufficiency of funds or credit; or it would have been dishonored for the same reason had not the drawer, without any valid cause, ordered the bank to stop payment. Nag-bounce ang check dahil na-dishonor ito for insufficiency of funds dahil walang laman ang checking account ng drawer, or nag-issue ng stop payment order pero it would have still bounced because of insufficiency of funds.
